In line with our values, we recognize that disputes may occasionally arise. This Alternative Dispute Resolution (ADR) Policy outlines our commitment to resolving any disputes efficiently, amicably, and without the need for prolonged litigation.

This policy applies to all disputes arising from services provided by Giesweb, including but not limited to:
– Public Relations Consulting
– Project Studies and Management
– Business Management and Development
– UI/UX Design
– Website and Application Development
– Graphic Design and Branding
– Visa Consulting Services
Commitment to Amicable Resolution
Giesweb is committed to:
– Addressing complaints and disputes promptly and fairly.
– Encouraging open communication and negotiation to resolve issues informally before escalating to formal proceedings.
– Seeking mutual agreement through dialogue as the first step toward resolution.
ADR Procedures
1 Negotiation
Upon the emergence of any dispute, both parties shall first attempt to resolve the issue through direct, good-faith negotiations.
Each party will make reasonable efforts to communicate clearly and offer solutions to resolve the dispute within 30 calendar days.
2 Mediation
If a resolution cannot be reached through negotiation, the parties agree to attempt to settle the dispute through mediation:
– Mediation will be conducted by a neutral third-party mediator mutually agreed upon by both parties.
– The mediation will take place in Tunis, Tunisia, and will be conducted in either French, Arabic, or English, depending on the parties’ preferences.
– Costs associated with mediation will be shared equally by both parties unless agreed otherwise.
The goal of mediation is to facilitate constructive dialogue and reach a voluntary, mutually acceptable agreement.
3 Arbitration
If mediation fails to resolve the dispute, the parties agree to submit the dispute to binding arbitration, under the rules of the Centre de Conciliation et d’Arbitrage de Tunis (CCAT) or any other recognized arbitration institution agreed upon by the parties.
– The arbitration shall be conducted in Tunis, Tunisia.
– The decision of the arbitrator shall be final, binding, and enforceable in any court of competent jurisdiction.
Legal Rights
Nothing in this policy restricts either party’s right to seek immediate injunctive relief or legal action if necessary to prevent irreparable harm.
Governing Law
This ADR Policy is governed by and construed in accordance with the laws of the Republic of Tunisia.
